Litigations and Trial Experience: Mr. Shimane has extensive litigation and trial experience in State court emphasizing the defense and prosecution of personal injury/tort actions, including motor vehicle accidents, premises liability, product liability, minor’s compromises and interpleader actions, resulting in more than ten jury trials to conclusion, many bench trials, over 200 binding and judicial arbitrations, and over 100 mediations.
Appellate Experience: Mr. Shimane has argued in front of the Court of Appeal, Sixth Appellate District.
Alternative Dispute Resolution: Mr. Shimane has been retained as a private arbitrator and mediator by individuals and by large insurance carriers. He regularly conducts judicial arbitrations and acts as a Judge Pro Tempore for the Santa Clara County Superior Court.

Client: Elaine Rausch, Defendant
Principal Issue: Questionable causation of injuries resulting from an automobile accident. Claimed injuries were spinal disc herniations and head trauma.
Result: Verdict for Defendant.
King v. Neubert, 2004, San Mateo County Superior Court.
Client: Randy Neubert, Defendant
Principal Issue: Disputed liability trip and fall at a wedding reception at a hotel in Burlingame. Defendant had set up lighting equipment for the dance floor. Plaintiff claimed the need for bilateral knee replacements.
Result: Verdict for Defendant.
Coulrup v. Roberts, 2001, Santa Clara County Superior Court.
Principal Issue: Causation of injuries from a cabinet falling onto plaintiff in a rental house. Defendant had installed the cabinet. Claimed injuries were disc herniations in the low back with resultant failed surgery.
Result: Verdict for Defendant.
Scott v. Acme Company, 1994, Santa Clara County Superior Court.
Client: Acme Company, Defendant
Principal Issue: Failure to warn on the label of a shower cleaning product. Claimed injury was the loss of a finger due to a strep infection caused by compromise of the skin by the cleaner.
Result: Verdict for Defendant.
Doe v. More, 1996, Binding Arbitration.
Client: Michael More, Defendant
Principal Issue: Liability for a nighttime automobile accident on Monterey Highway in Gilroy. Plaintiff was a pedestrian crossing the highway walking his bicycle and was struck by More’s vehicle. Claimed injuries were severe head trauma and numerous fractures.
Result: No liability on Defendant.
